1. GENERAL
1.1. These are the terms and conditions of sale of SAS EUROSLEEP, whose registered office La Maison du Dos is at 5 Rue du Moulin, Pautaines, 52270, France. Registered in France with Company Number RCS 808 821 029 and VAT Number FR48808821029 .These terms apply to the purchase of products saling in the www.la-maison-du-dos.com website for the United Kingdom, Europe and Rest of World. We recommend that you read this document carefully before placing your order. We reserve the right to make changes to these Sale Terms at any time. You will be subject to the Sale Terms in force at the time you place your order with us.
2. YOUR ORDER
2.1. Every order that you place on this website will be subject to acceptance in accordance with these Terms and Conditions. The final details of your order will be set out on the "Check Out" page prior to proceeding to the "Payments" pages. After the authorization of your credit card, we will send you an email confirming receipt of your order detailing the products you have ordered together with an order number. This email is not an order confirmation or order acceptance from La Maison du Dos. We reserve the right to cancel any order and/or refuse access to the website. It is your responsibility to inform us immediately if there are any errors in your order.
3. PRODUCT GUARANTEE
3.1. La Maison du Dos offers a two years guarantee against possible defects of all products. The guarantee starts from the date the product was purchased. In the event of a defect arising during the guarantee period, please contact La Maison du Dos by email at info@la-maison-du-dos.com or by telephone at +33 (0)3 25 04 20 19.
3.2. La Maison du Dos will repair your replace it with a similar product, free of charge. When making a claim, you will need to provide your original dated receipt or invoice from La Maison du Dos .
3.3. This guarantee does not cover any damage caused by misuse or neglect.
3.4. This guarantee does not cover the cost of returning the product to our nominated repairs location.
3.5 Watermatresses in Vinyl EN-71 are 5 years garantied : 2 years at 100%, than the third year at 30 % than 20 %, than 10% the fifted year.
3.6 The Vinyl Mesamoll 2 watermatress are 10 years garantiee : the first 5 years at 100 %, and from the sixties with 50 % garantie to 10 % the tenth year, each year with 10 % less garantee value
3.6 Tthe guarantee is not transferable and concerns only the first purchaser. The purchases of annual conditionners at La Maison du Dos for the maintenance of watermattresses must be provided as well as the purchase from the watermattress or waterbed.
3.7 the guarantee relates only to the lack of welding of the vinyls
4. PRICE
4.1. The price that you pay for the product will be the price that is displayed on the website at the "Check Out" stage. All prices are quoted in Euro and are inclusive of value-added tax (VAT) where applicable, but exclude any delivery charges.
4.2. All purchases are usually invoiced at an amount inclusive of VAT at 20%..
4.3. We will take payment from your credit card after you confirm the "Check Out" stage of the order. If we are unable to supply the product that you have ordered, we will contact you by telephone and/or e-mail to offer you either a full refund or a substitute product. If we do not receive a response from you within 24 hours of our first attempt to contact you, we will refund the total amount we deducted from your credit card.
4.4. We will endeavor to ensure that all prices on our website are accurate. However, pricing errors may occur. If an error is found in the price of the product you have ordered, we will contact you as soon as possible. If a product′s correct price is lower than the price stated on our website, we will charge the lower amount to your credit card and send the product to you. If a product′s correct price is higher than our stated price, then we will give you the option of either continuing with your purchase at the correct price or canceling the order affected by the error. We will deem the order cancelled if we do not receive a response from you within 24 hours of our first attempt to contact you. In such a case, we will refund the total amount we deducted from your credit card.
4.5. For deliveries outside of the European Union, you may be required to pay import duty, custom charges or other local taxes. Customs policies vary widely from country to country so please contact your local customs office for further information. Please note that the payment of any import duties, customs charges, local taxes or any administration charges paid to couriers in relation to these fees, is for your own account. La Maison du Dos cannot be held responsible for the payment of any of the abovementioned charges.
5. DELIVERY
5.1. We will attempt to deliver the Goods to the place designated by you in the accepted order, during normal business hours. We may employ a third party company as our carrier to make these deliveries.
5.2. Unless otherwise expressly agreed in writing, any delivery date or time specified by us in any quotation, despatch note or otherwise, is a best estimate only and we will not be liable to you for any loss or damage sustained by you if we fail to meet that timescale because of circumstances beyond our reasonable control.
5.3. La Maison du Dos charge for deliveries made outside of France. The delivery costs, as quoted, are for your account. A delivery charge will be added to your order prior to acceptance, and will be paid by you.
6. RISK AND TITLE
6.1. Ownership of the Goods and the risk of damage to the Goods will pass to you upon delivery.
7. DAMAGE OR LOSS IN TRANSIT
7.1. We shall replace, free of charge, any Goods damaged or lost in transit where delivery has been made by our carrier, provided that you give us written notification of such damage or loss within 14 days of the date of receiving the Goods (so that we may comply with our carrier′s conditions of carriage).
8. YOUR RIGHT OF CANCELLATION
8.1. You have the right to cancel the Contract for the purchase of any of the Goods within 7 working days of delivery. A working day is any day other than weekend and bank or other public holidays. This possibility doesn't exist for used waterbeds or watermatressses.
8.2. We are obliged to exchange the goods or provide you with a full refund provided that, where delivery has taken place, you have returned the Goods to us in the same condition that they were delivered.
8.3. If you choose to exercise your right of cancellation after the Goods have been delivered to you, please call our technical department on +33 (0)3 25 04 20 19 to obtain a Returns number. Wherever possible, you should package the unused goods securely in the original packaging and return them to : La Maison du Dos - Eurosleep 5 Rue du Moulin, Pautaines, 52270, France
8.4. For your own protection, we recommend that you use a recorded delivery service. You are responsible for the cost of returning the Goods to us, unless we delivered the items to you in error or the Goods are faulty.
8.5. If you do not return the Goods as required by this Contract, we may charge you a sum not exceeding the direct costs of recovering the Goods.
9. LIMITATION OF LIABILITY
Our aggregate liability (whether in contract, tort or otherwise) for any loss or damage shall, in any event, be limited to a sum equal to the amount paid for the product in question.
10. GOVERNING LAW
This Contract is governed by the laws of France and the French courts shall have the exclusive jurisdiction to resolve any disputes arising out of or under it.
11. AMENDMENTS
We reserve the right to make changes to these Sale Terms at any time. You will be subject to the Sale Terms in force at the time you place your order with us.
